Analysis of the Fire Chief Washington case – Episode 58

 

This episode discusses where things stand with the federal complaint filed by former Fire Chief Washington over the City  Manager’s decision to fire him in March 2023.  It is a complicated case that includes elements of procedural errors, civil rights violations, and significant implications for city management and accountability. On August x, 2026, Chief Washington  won a major victory in the 6th Circuit U.S. Court of Appeals when it upheld the decision of the District Court, which found that the City Manger handled the matter in such a way that she violated the former Chief’s civil rights. She denied the Chief a pre-determination hearing even though the city’s law departemt advised her that such a hearing was required under the city’s charter.  As a result the District Court determined that as a result, the City Manager lost statutory immunity from personal liability and any associated damages.  The 6th Circuit agreed so the case now goes back to the District Court.
